1. INTRODUCTION
These Terms of Service ("Terms") govern the use of smileke.com (the "Website") and all purchases made through it from Smile Kenya LTD ("SmileKE", "we", "us"). By accessing the Website or placing an order, you agree to be bound by these Terms.

2. ELIGIBILITY
You must be at least eighteen (18) years of age to place an order. By placing an order, you confirm that the information you provide is true, accurate and complete.

3. PRODUCTS
3.1 Products are cosmetic oral care products intended for adult use only. They are not medicines and are not intended to diagnose, treat or cure any medical or dental condition.
3.2 Results vary from person to person. Images on the Website are for illustration purposes.
3.3 Customers must read and follow the instructions for use. Persons who are pregnant or breastfeeding, or who have gum disease, dental restorations, or tooth sensitivity, should consult a dentist before use.
3.4 We make every effort to display products accurately; however, minor variations in packaging may occur.

4. ORDERS
4.1 An order constitutes an offer to purchase. All orders are subject to confirmation by telephone or WhatsApp.
4.2 SmileKE reserves the right to refuse or cancel any order, including orders that cannot be confirmed, appear fraudulent, or contain incorrect information.

5. PRICES AND PAYMENT
5.1 All prices are in Kenya Shillings (KES) and include applicable taxes.
5.2 Payment is made by cash on delivery at the time the order is received.
5.3 We reserve the right to change prices at any time. The price applicable to an order is the price displayed when the order was placed.

6. DELIVERY
Delivery is governed by our Shipping Policy, which forms part of these Terms.

7. RETURNS AND REFUNDS
Returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

8. INTELLECTUAL PROPERTY
All content on the Website, including text, images, graphics, logos and design, is the property of SmileKE or its licensors and may not be copied, reproduced or used without prior written consent.

9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, SmileKE shall not be liable for any indirect, incidental or consequential loss arising from the use of the Website or the products, including any adverse effect resulting from failure to follow the instructions for use. Our total liability for any claim shall not exceed the amount paid for the relevant order. Nothing in these Terms limits any right that cannot be excluded under Kenyan law.

You agree not to use the Website for any unlawful purpose, to place false orders, or to interfere with the operation or security of the Website.

11. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Republic of Kenya. Any dispute shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
